Holden Smith Consultancy (HSC) were commissioned to provide professional judgment on the true value for the sum due as loss and expense for delay suffered by its client.

The process

HSC reviewed the terms of the contract and identified the specific requirements for, and managed the procurement of, key evidence. HSC assessed the evidence which included the carrying out of factual demonstrations concerning planned and actual progress and productivity in a delay analysis. The results of the assessment were evaluated in accordance with the contract and relevant legal principles to arrive at quantum for the sum due for delay as Prolongated Preliminaries and a Preliminary Thickening.

Result

The claim was submitted and after a period of negotiation HSC client received payment of £600,000 for the claim without the need for Adjudication to the benefit of all stakeholders in the avoidance of a dispute.
