Construction Contract Review Service

A Contract that is within your understanding of the agreement and within your parameters for risk is essential to you being able to achieve your desired outcomes, avoid disputes, and unnecessary costs.

Construction Contract Review Service | We Identify & Mitigate Risks Affecting the Quantum of your Payment Entitlement, or Obligations Arising Under Your Contract.

Following our years of industry experience and in direct response to our client's evolving business needs, we have developed a fixed fee Contract Review Retainer Service ensuring:

  • Costs certainty and transparency.

  • Fixed priority turnaround times.

  • Access to pragmatic and jargon-free industry specialists

  • Consistent and robust approach to contract advice.

As advocates of and signatories to the RICS-backed Conflict Avoidance Pledge, the aim of offering a retainer service is to make professional contract reviews more accessable and to avoid costly, relationship-damaging, and time-consuming disputes by assisting you in agreeing on contract terms that are:

  • Within your understanding of the agreement.

  • Within your parameters for risk.

  • Commercially viable.

  • Practically manageable.

  • Effective at avoiding disputes, maintaining relationships, and saving costs.

How does the Retainer service work?

Recognising that each business is unique, we provide a bespoke, fixed-cost retainer package based on your specific requirements. Depending on your preference, the fixed retainer fee (ranging between £57.69 and £295+ per week) can be paid weekly in advance at the start of each period or by monthly payments at the start of each month.

What services does the Retainer cover?

Our Contract Review service is aimed at providing contractual advice on risks that could affect the quantum of your payment entitlement or obligations arising under your contract.

Specifically, the services cover:

  • Contract Reviews.

  • Contract Amendments.

  • Collateral Warranty Reviews.

  • Collateral Warranty Amendments.

  • Contract Risk Registers.

  • Support and consultation throughout the process of agreeing terms.

What is the Review process under the Retainer?

Under our process:

1. You provide us with the proposed contract and terms on which your tender bid was based.

2. We review the contract and provide a Contract Review Risk Register, and:

  • Identify Risks and show a severity rating for the risk.

  • Provide a mitigation action for each risk identified and show a revised severity rating.

  • Incorporate any terms you require into the contract.

  • List any special advice or observations.

  • List any areas where further information is required.

3. The completed Contract Review Risk Register is sent to you so you may confirm whether you wish to accept the risks or proceed with any proposed mitigation action.

4. Following your confirmation, we transfer the contract amendments into a worksheet that can go directly to the other party to the contract for their agreement/comment.

5. You may then use the worksheet to correspond with the other party throughout the agreement process so that all agreements are recorded progressively in the worksheet; we are also available for support as required.

6. After an agreement on terms, we review the final draft of the contract against the worksheet to ensure the agreed terms are properly incorporated.

Following this tried and tested process, our clients have a contract that is:

  • Within their understanding of the agreement.

  • Within their parameters for risk.

  • Commercially viable.

  • Practically manageable.

  • Effective at avoiding disputes and maintaining relationships.

In our experience, consistently taking this proactive approach gives our clients the most effective opportunity to avoid conflicts by taking action at the earliest possible stage.
