Overview

A right to suspend for non-payment, with an extension of time for the period of suspension and "a reasonable amount in respect of costs and expenses reasonably incurred by that party as a result of the exercise of the right", is provided pursuant to statutory legislation set out under Section 112 of the Housing Grants, Construction and Regeneration Act 1996, as amended by the Local Democracy, Economic Development and Construction Act 2009, (the 'HGCRA 1996'.) Suspension may also occur pursuant to the express terms as agreed between the parties, or in breach of the express, or implied terms of the contract.


Consequences of suspension can include losses arising from:

  • plant and equipment.

  • delay and disruption.

  • performing additional site visits.

  • revised programmes.

Additionally consideration must also be given to possible effects on guarantees, warranties, insurances, and price increases.


Quantum for losses resulting from the suspension

Costs incurred as a result of the exercise of suspension may be valued pursuant to the HGCRA 1996 and in accordance with any applicable agreed terms.  We specialise in quantifying losses arising from the the exercise of suspension.
